Institutional Arbitration Services
To initiate this arbitration method of services, there must exist a dispute resolution clause or agreement between the disputing parties and such agreement should mention the disputing parties’ consent to submit their disputes to the Sole Arbitration or Panel of Arbitrators appointed solely by the Vishlaw Global Center for Dispute Resolution, Chennai.
To invoke institutional arbitration, the following must exist:
- Parties must have a valid arbitration agreement in place, and
- Such agreement should be in writing, and
- Such agreement can be part of the main contract or a separate agreement, and
- Such agreement must state that all disputes will be resolved through binding arbitration.
- Dispute should not be prohibited from Arbitration Proceedings.
- Such agreement should authorize Vishlaw Global to appoint sole arbitrator or panel of arbitrators to adjudicate the matter/s in dispute.
Court Ordered Arbitration
Court-ordered arbitration proceedings conducted by an institution like the Vishlaw Global refer to a legal process where a court compels parties in a dispute to resolve their differences through arbitration, as administered and supervised by an established arbitral institution such as Vishlaw Global. This typically occurs when a contract between two parties includes an arbitration clause that mandates the use of arbitration for dispute resolution. If a dispute arises, and one party initiates litigation in court instead of adhering to the arbitration agreement, the court may issue an order directing the parties to proceed with arbitration as per the terms of their contract.
Managed Arbitration Services
In the absence of a specific agreement between the parties for the appointment of a Sole Arbitrator by Vishlaw Global, Vishlaw Global role will be limited to providing a list of potential Arbitrators for the parties’ consideration. The parties may select an Arbitrator of their preference from this list. In such instances, Vishlaw Global will exclusively aid the appointed Arbitrator in the arbitration process. This assistance may include tasks such as sending legal notices, scheduling hearing dates, maintaining records at the request of the Arbitrator, arranging a venue for arbitration proceedings, and providing other logistical support to ensure the arbitration process is conducted smoothly and efficiently. Vishlaw Global Institutional Rules will not apply to this Arbitration Services.
